To provide you care, Andrew Lister, D.O., and Bee You Psychiatry and Therapy Services, PLLC (the “Practice”) must collect, create, and maintain health information about you, which includes individually identifiable information relating to your past, present, or future physical or mental health, the care you have received, or payment for your care. The Practice is required by law to maintain the privacy of this information, to provide you with this Notice of its legal duties and privacy practices, and to abide by the terms of the Notice currently in effect.

We may use and disclose your health information to provide and coordinate your treatment with other providers; to obtain payment and assist other providers in obtaining payment, including determining eligibility for benefits; and to support our health care operations, such as quality improvement, care management, evaluating our performance, and resolving complaints or grievances.
Uses and Disclosures Permitted Without Your Authorization
To the extent permitted by law, we may use or disclose your health information without your authorization: as required by law; for public health activities (such as reporting disease, births, deaths, or child abuse or neglect); to report suspected abuse, neglect, or exploitation of a child or a vulnerable or elderly adult; for health oversight activities such as audits and licensing; in judicial and administrative proceedings in response to a lawful order or process; for specified law enforcement purposes; to coroners, medical examiners, and funeral directors; for organ and tissue donation; for approved research; to avert a serious threat to health or safety; for specialized government functions; for workers’ compensation as authorized by law; and to family members or others involved in your care when you do not object or in your best interest if you are unavailable. We may also contact you with appointment reminders and information about treatment alternatives or health-related services.
Specially Protected Information
Certain information receives heightened protection under state and federal law and may be subject to additional restrictions before disclosure, including psychotherapy notes, substance use disorder treatment records protected under 42 C.F.R. Part 2, HIV/AIDS-related information protected under Florida law (Fla. Stat. § 381.004), and genetic information. Disclosures of these records are subject to those special protections.
Uses and Disclosures Requiring Your Written Authorization
Other uses and disclosures will be made only with your written authorization, including most uses and disclosures of psychotherapy notes, uses and disclosures for marketing, and any disclosure that constitutes a sale of health information. You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.
Your Rights Regarding Your Health Information
You have the right to: inspect and obtain a copy of your health information that we maintain (subject to limited exceptions); request that we amend information you believe is incorrect or incomplete; receive an accounting of certain disclosures; request restrictions on certain uses and disclosures (and we must agree to a request to restrict disclosure to a health plan for an item or service you paid for in full out of pocket); request confidential communications at an alternate location or by an alternate means; receive notification of a breach of your unsecured health information; and receive a paper copy of this Notice upon request.
If a fee applies for copies of your records, our charges will not exceed the amounts permitted under Florida law (Fla. Stat. § 456.057 and Fla. Admin. Code R. 64B8-10.003), which are no more than $1.00 per page for the first 25 pages and $0.25 per page thereafter, plus actual costs of mailing; for an electronic copy of records we maintain electronically, the fee will not exceed the limit permitted under the HIPAA right of access. We may provide records needed for continuity of your care without charge. To exercise any of these rights, please contact the Practice.
